It’s Football Time in Tennessee!

The college football season is almost here, and The Law Offices of John Day is excited to announce that once again it will offer Middle Tennessee State University Blue Raiders fans discounted Lyft rides home after the game.  Read on to learn how to take advantage of this offer and why you should.

There is nothing wrong with enjoying adult beverages before and after a football game.  Tailgating is a national pastime during football season.  Celebrating or lamenting your team’s fortune in a bar after the game is part of the fun.  But, it is critically important to enjoy football season responsibly.  One study suggested that the number of drunk drivers on the road on game day increases by 13%.  Another survey revealed that ¼ of tailgaters admit to drinking more than 5 alcoholic beverages as part of the game’s festivities.

Remember, the legal limit in Tennessee is a .08 BAC.  And, as refresher of the consequences, a first-time offender in Tennessee will spend 48 hours in jail and up to 11 days and 29 months.  If your BAC is 2.0 or higher, it is a minimum of 7 days in jail.  Your license will be revoked for one year. You will be ordered to participate in an alcohol or drug treatment program at your expense. You will be financially responsible for any harm you cause in an accident. (If you do hurt someone in the accident, the criminal charges and potential consequences will almost certainly be more serious) The fine will range from $350 to $1500.  An ignition interlock will be placed on your vehicle at your expense, roughly $1000.00.  Your car will be towed.  Your insurance will increase. You will have to pay for bail, an attorney, court costs, etc.  Of course, there are other negative implications. For example, the embarrassment of the criminal process.  The missed time from work while in jail, to attend court or treatment programs.  Finally, if you hurt or kill someone, the burden of knowing your actions affected someone else so profoundly.
